Michael Di Biase will get his day in court.
During a brief hearing this morning, Ontario court Justice Peter Howden ruled the former Vaughan mayor's case will continue to trial.
Last week lawyers representing the city petitioned the judge to toss the case, which seeks to have the November election declared invalid.
If Di Biase is successful, the judge could order a hand recount of the ballots, a new election or uphold the official results.
